Official Rules

NO PURCHASE NECESSARY TO PARTICIPATE OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW.

1. Eligibility: The Dr Pepper® CASO College Football Playoff National Championship Game Sweepstakes (the “ Sweepstakes ”) is open only to legal US residents currently residing in the forty eight (48) Continental United States and the District of Columbia, excluding Puerto Rico and it’s territories (“Eligibility Area”) who are twenty-one (21) years of age or older as of the date of their entry (“Entrant”). Bottlers, employees, directors and officers of Dr Pepper/Seven Up, Inc. (“ Sponsor ”), Amp Activate c/o Upshot LLC (“ Administrator ”), CFP Events, Inc., CFP Administration, LLC, or the College Football Playoff Foundation, Inc. and any of their respective affiliates, parents, subsidiary companies, and advertising and promotion agencies (collectively, the “ Released Parties ”), and members of the immediate families (spouses, parents, children/step-children, and siblings/step siblings and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing, are not eligible. Employees (and their family members/household) of any retailer where a sweepstakes is promoted or held are excluded from participation in this promotion. The Promotion is subject to all applicable federal, state and local laws . By participating in the Promotion, you agree that: (1) you have read and understand the Official Rules; (2) you meet the Promotion eligibility requirements as explained in the Official Rules; (3) you accept and agree to be bound by these Official Rules, to Sponsor's Conditions of Use , Legal Notices and Privacy Policy as published at https://www.keurig.com/content/privacy-policy; and (4) you unconditionally accept and agree to comply with and abide by the decisions of Sponsor and Administrator, whose decisions shall be final and binding in all respects.

2. Sweepstakes Period: The Sweepstakes begins at 12:00:00 AM Eastern Time (“ET”) on 8/1/25 and ends at 11:59:59 PM ET on 11/30/25 the “ Sweepstakes Period ”).

3. How to Enter : During the Promotion Period, visit www.drpeppersweeps.com/cfp ( “ The “Promotion Site”) or scan the QR code which can be found on promotion point of sale materials at participating stores. The code will take you to the website where you will complete the information requested on the entry form to enter. There is a limit of one (1) entry (“Entry”) per person per day throughout the entire promotion period. No incomplete or automated Entries will be accepted. Multiple Entrants are not permitted to share the same email address. Incomplete Entries, Entries generated by script, macro or other automated means, or Entries that do not fully comply with these Official Rules, or Entries which subvert the entry process, in the sole discretion of Sponsor, shall be ineligible. Proof of submission of Entry does not constitute proof of delivery or entry during the Promotion Period. All entries become the exclusive property of Sponsor and will not be acknowledged. In the event of any dispute concerning the identity of any Entrant, the relevant entry will be deemed submitted by the authorized account holder of the email address associated with the Entry and such individual must comply with these Official Rules. To participate in this Promotion, each Entrant will be subject to Sponsor’s Terms of Use (https://www.keurigdrpepper.com/en/term-of-use) and Privacy Policy (https://www.keurig.com/content/privacy-policy) where applicable.

All Entries must be received during the Sweepstake Period to be eligible. In the event of a dispute as to the person responsible for any Entry, the authorized account holder of the email address provided, or the Mobile Device used to Enter will be deemed to be the participant. The "authorized account holder" of an email address, is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The "authorized account holder" of a Mobile Device is the natural person in whose name the Mobile Device has been issued and the services are billed. Potential winners may be required to show proof of being an authorized account holder. All Entries become the property of Sponsor and will not be acknowledged or returned. Multiple participants are not permitted to share the same email address or Mobile Device. Any attempt by any participant to obtain more than the stated number of Entries by using multiple/different email addresses, Mobile Devices, phones, identities, or any other methods, may void such participant’s Entries, at Sponsor’s sole discretion. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, untranslatable, incomprehensible, or misdirected Entries. If you chose to participate via a Mobile Device, other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Sweepstakes. Mobile Device service may not be available in all areas. Check your Mobile Device’s capabilities for specific instructions.  

3. Entry Periods/Prize Drawing/Prizes/Approximate Retail Value (“ ARV”): On or about two (2) business days after each Entry Period has ended, Administrator, an independent judging agency, shall perform a prize drawing from among all eligible entries for the corresponding Entry Period to select the potential Grand Prize Winner (“Grand Prize Winner”). Once confirmed, as detailed below, the Grand Prize winner will win a trip to the 2026 College Football Playoff National Championship at the Hard rock Stadium in Miami, FL on January 19, 2026 for two (2) with two (2) nights at a sponsor specified hotel (one, standard-double occupancy room), one (1) pair of tickets to the game, two (2) welcome event passes, two (2) game day breakfast, two (2) pre-game party, round-trip airline tickets for two (2) and airport transportation , (ARV: $8,270) . A potential winner that is 250 miles or closer from the trip destination will receive a gift card (ARV: $200) for travel in lieu of a flight , ($6,670). The total ARV of all prizes available to be awarded in the Promotion is eight thousand two hundred and seventy dollars ($8,270). The total ARV of all prizes available without airfare to be awarded in the Promotions is six thousand six hundred and seventy dollars ($6,670).

Grand Prize Winner must use accommodations on the dates determined by Sponsor in its sole discretion or Prize will be forfeited. Accommodations are subject to availability. All expenses and incidental travel costs associated with prize acceptance and use not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, baggage fees, passenger tariffs or duties, airline fees, surcharges, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of Grand Prize Winner. Travel companion must be twenty-one (21) years of age or older or a minor under the guardianship of the Winner. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Prize Winner will not receive difference between actual and approximate retail value. Grand Prize Winner will not be reimbursed for tickets. Tickets may be subject to their standard rain-check policies and procedures. By accepting ticket Prize, Grand Prize Winner agrees to abide by any terms, conditions and restrictions provided by the ticket. Grand Prize Winner and guest will be required to comply with all venue rules and regulations, including all COVID-19 protocols in effect at the venue and hotel during duration of trip. Failure to do so may result in forfeiture of the Prize as determined by Sponsor. Prize Winner and guest fully understand that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including the protocols that may be implemented from time to time based upon public health and government-sponsored guidelines (collectively, the “Protocols”), can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition. All federal, state, and other tax liabilities arising from accepting a Prize in this Sweepstakes are the sole responsibility of the applicable Grand Prize Winner. The Grand Prize Winner will receive an IRS Form 1099 at the end of the tax year in which they accepted the Prize for the actual value of the Prize awarded. Tickets may not be resold or offered for resale. Any such resale may result in disqualification and Prize forfeiture and may invalidate the license granted by the ticket(s). Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. The decisions of Administrator and Sponsor are final and binding on all matters relating to this Promotion. The potential Prize Winner is not an official winner unless and until Sponsor/Administrator confirms such. Odds of winning a Prize are dependent upon the total number of eligible Entries received throughout the Sweepstakes Period. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All Prize details are at Sponsor’s sole discretion.
There is a limit of one (1) Prize per person, for the entire Promotion Period.

3. Prize Winner Notification/Verification/Prize Restrictions: The Released Parties are not responsible if the Sweepstakes cannot take place as planned for any reason and accept no liability whatsoever if the Sweepstakes is cancelled, delayed, rescheduled, postponed, or otherwise impacted in any way. The potential Grand Prize winner will be notified via the email address or phone number on two (2) business days after the Prize Drawing. Administrator will make two (2) attempts to contact the potential Grand Prize winner via such method. Potential Grand Prize Winner will have three (3) business days from the time of the first notification attempt to respond to Administrator or potential winner will be disqualified and Administrator will select/notify an alternate potential winner. Potential Grand Prize winner will be required to execute and return a Declaration of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of notification. If such documents are not returned within the specified time, the Prize may be forfeited at Sponsor’s discretion. If in any instance, notification attempt(s) for the potential winner fail for any reason, or if a potential winner is found to have not complied with these Official Rules, fails to return any of the requested documents within the timeframe provided, or cannot accept the Prize for any reason, the applicable Prize will be forfeited and an alternate potential winner will be selected from among remaining eligible Entries for that drawing, if any. By accepting a Prize in the Sweepstakes, all potential/confirmed winners hereby consent to the use by the Sponsor of their Entry and all information contained therein including but not limited to, name, likeness, opinions, images, statements and/or other indicia of persona, and personally-identifiable information (collectively “ Likeness ”), for any and all uses and purposes (including, without limitation, for purposes of advertising and trade) in any media now known or hereinafter developed in any manner throughout the world (including, without limitation, the World Wide Web and on-air) in perpetuity without additional consideration (where legal), consent or prior review, and upon request will provide written consent to such use. All decisions of Sponsor/Administrator relating to the Sweepstakes and drawings are final.

3. General Terms: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY ENTRANTS OR WINNERS OR ANY BEHAVIOR BY A WINNER THAT WILL BRING SUCH WINNER OR SPONSOR INTO DISREPUTE (IN SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH PRIZE WINNER’S DISQUALIFICATION FROM THE SWEEPSTAKES AND FORFEITURE OF ANY PRIZE. Released Parties assume no responsibility for incorrect or inaccurate Entry information whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error, which may occur in the processing of the Entries in this Sweepstakes. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or other services, or providers, computer equipment, software, failure of any email due to technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the Prizes, fulfillment of Prizes, or in any Sweepstakes-related materials. All interpretations of these Official Rules and decisions by Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated Entries are permitted. Sponsor reserves the right in its sole discretion to disqualify any individual (and void all associated Entries) it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated means of entry or any other means to subvert the entry process; (ii) to have tampered with the entry process or the operation of this Sweepstakes; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, RELEASED PARTIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Entrants agree that the Released Parties (a) shall not be responsible or liable for, and hereby release the Released Parties from, any claims, losses, damages or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, receipt, possession and/or use/misuse or inability to use the Prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose. Released Parties shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties; or (3) by any other cause, condition or event whatsoever beyond the control of the Released Parties. Failure of Sponsor to enforce any provision herein shall not be deemed a waiver of such. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the Prizes will be awarded via random drawings from among all eligible Entries received for each drawing up until the time of termination, or in a manner that is fair and equitable as determined by Sponsor. In such event, Sponsor reserves the right to award the Prizes at random from among the eligible Entries received throughout the Sweepstakes Period and overall, up to the time of the impairment. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If any part of these Official Rules is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty and liability disclaimers set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and these Official Rules shall continue in effect. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, INDIRECT, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL RELEASED PARTIES BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZES TO BE AWARDED TO AN INDIVIDUAL ENTRANT IN THIS SWEEPSTAKES.

3. Governing Law/Venue : THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN TEXAS. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF. THE RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED IN PROMOTIONAL LAW AND LICENSED TO PRACTICE LAW IN TEXAS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF COLLIN OR DALLAS, TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

Todas las Entradas pasan a ser propiedad del Patrocinador y no se reconocerán ni devolverán. No se permite que varios participantes compartan la misma dirección de correo electrónico o Dispositivo móvil. Cualquier intento por parte de un participante de obtener un número de Entradas mayor al establecido mediante el uso de varias/diferentes direcciones de correo electrónico, Dispositivos móviles, teléfonos, identidades o cualquier otro método, podrá anular las Entradas de dicho participante, a exclusivo criterio del Patrocinador. El uso de cualquier sistema automatizado para participar está prohibido y resultará en la descalificación. El Patrocinador no es responsable de las Entradas perdidas, demoradas, incompletas, inválidas, ininteligibles, intraducibles, incomprensibles o extraviadas. Si usted decidió participar a través de un Dispositivo móvil, es posible que se apliquen otros cargos (como los cargos normales por tiempo de llamada y operador) y que aparezcan en su factura de teléfono móvil o se deduzcan del saldo de su cuenta prepaga. Los planes de tarifas de los operadores de telefonía móvil pueden variar, por lo que deberá ponerse en contacto con su operador de telefonía móvil para obtener más información sobre los planes de tarifas de mensajería y los cargos relacionados con su participación en este Sorteo. Es posible que el servicio de Dispositivos móviles no esté disponible en todas las zonas. Verifique las capacidades de su Dispositivo móvil para obtener instrucciones específicas.  

4. Períodos de entrada/Sorteo de premio/premios/valor aproximado de venta al público (“ VAVP”): aproximadamente dos (2) días laborales después de que haya finalizado el Período de entrada, el Administrador, una agencia de evaluación independiente, realizará un Sorteo de premio entre todas las entradas elegibles para seleccionar al posible ganador del Gran premio (“Ganador del Gran premio”). Una vez confirmado, como se detalla a continuación, el ganador del Gran premio recibirá un viaje para dos (2) personas al Campeonato Nacional de la Fase Eliminatoria de Fútbol Americano Universitario de 2026 en el Hard Rock Stadium de Miami, FL, el 19 de enero de 2026 que incluye dos (2) noches en un hotel especificado por el patrocinador (una habitación doble estándar), un (1) par de pases para el partido, dos (2) pases para el evento de bienvenida, dos (2) desayunos el día del partido, dos (2) fiestas antes del partido, pasajes de avión de ida y vuelta para dos (2) personas y transporte al aeropuerto , (VAVP: $8,270) . Un posible ganador que viva en un radio de 250 millas o menos del destino del viaje recibirá una tarjeta de regalo (VAVP: $200) para viajar en lugar de un vuelo , ($6,670). El VAVP total de todos los premios disponibles para otorgar en la Promoción es de ocho mil doscientos setenta dólares ($8,270). El acompañante de viaje debe tener veintiún (21) años de edad o más, o ser un menor de edad bajo la tutela del Ganador. El Patrocinador no reemplazará ningún pase, váucher de viaje o certificado perdido, destruido o robado. El Ganador del premio no recibirá la diferencia entre el valor minorista real y el aproximado. No se reembolsarán los pases al ganador del Gran premio. Los pases pueden estar sujetos a sus propias políticas y procedimientos habituales de entrega de vales. Al aceptar el Premio del pase, el ganador del Gran premio acepta acatar cualquier término, condición y restricción establecida por el pase. El ganador del Gran premio y su acompañante deberán cumplir con todas las normas y reglas del lugar, incluidos todos los protocolos de COVID-19 vigentes en el lugar y el hotel durante el viaje. El Ganador del premio y su acompañante comprenden plenamente que (a) el nuevo coronavirus SARS-CoV-2 y cualquier enfermedad resultante (junto con cualquier mutación, adaptación o variación de este, “COVID-19”) es extremadamente contagioso y existe un riesgo inherente de exposición a la COVID-19 en cualquier lugar donde las personas estén o hayan estado presentes; (b) ninguna precaución, incluidos los protocolos que puedan implementarse ocasionalmente según las pautas de salud pública y gubernamentales (colectivamente, los “Protocolos”), puede eliminar el riesgo de exposición a la COVID-19; (c) si bien las personas de todas las edades y condiciones de salud han sido afectadas negativamente por la COVID-19, las autoridades de salud pública han determinado que ciertas personas presentan un mayor riesgo en función de la edad o de condiciones médicas subyacentes; y (d) la exposición a la COVID-19 puede conllevar el cumplimiento de requisitos de cuarentena, enfermedad, discapacidad, otros efectos para la salud a corto y largo plazo, o muerte, independientemente de la edad o condición de salud. Todas las responsabilidades fiscales federales, estatales y de otros tipos que surjan de la aceptación de un Premio en este Sorteo son responsabilidad exclusiva del ganador del Gran premio correspondiente. El ganador del Gran premio recibirá un Formulario 1099 del IRS al final del año fiscal de aceptación del Premio por el valor real del Premio otorgado. Los pases no pueden revenderse ni ofrecerse para la reventa. Cualquier reventa puede dar lugar a la descalificación y pérdida del Premio, y podrá invalidar la licencia concedida por los pases. Las decisiones del Administrador y del Patrocinador son definitivas y vinculantes en todos los asuntos relacionados con esta Promoción. La posibilidad de ganar un Premio dependerá de la cantidad total de Entradas elegibles recibidas durante el Período de vigencia del sorteo. Los premios se otorgan “tal como están” sin ninguna garantía expresa o implícita. Todos los detalles del Premio quedan a exclusivo criterio del Patrocinador.
Hay un límite de un (1) Premio por persona, para todo el Período de la promoción.

5. Notificación al ganador del premio/verificación/restricciones del premio: las Partes exentas no son responsables si el Sorteo no puede realizarse según lo previsto por cualquier motivo y no aceptan responsabilidad alguna si el Sorteo se cancela, retrasa, reprograma, pospone o se ve afectado de cualquier otro modo. Se notificará al posible ganador del Gran premio a través de la dirección de correo electrónico o el número de teléfono en el plazo de dos (2) días laborales después del Sorteo del premio. El Administrador realizará dos (2) intentos de contactarse con el posible ganador del Gran premio a través de dicho método. El posible ganador del Gran premio tendrá tres (3) días laborales desde el primer intento de notificación para responder al Administrador; o podrá ser descalificado y el Administrador seleccionará/notificará a un posible ganador alternativo. El posible ganador del Gran premio deberá firmar y devolver una Declaración de elegibilidad, un descargo de responsabilidad y, cuando esté permitido por ley, una autorización de publicidad en un plazo de siete (7) días a partir de la fecha de notificación. Si dichos documentos no se devuelven en el plazo especificado, el Premio podrá anularse a criterio del Patrocinador. Si, en cualquier caso, los intentos de notificación al posible ganador fracasan por cualquier motivo, o si se descubre que un posible ganador no ha cumplido con este Reglamento oficial, no devuelve alguno de los documentos solicitados dentro del plazo establecido o no puede aceptar el Premio por cualquier motivo, el Premio correspondiente se anulará y se seleccionará un posible ganador alternativo de entre las Entradas elegibles restantes para ese sorteo, si las hubiera. Al aceptar un Premio en el Sorteo, todos los ganadores posibles/confirmados consienten por el presente que el Patrocinador utilice su Entrada y toda la información contenida en esta, incluidos, entre otros, el nombre, la imagen, las opiniones, las imágenes, las declaraciones u otros indicios de la persona, y la información personal identificable (colectivamente, “ Imagen ”), para todos y cada uno de los usos y fines (incluidos, entre otros, los fines publicitarios y comerciales), en cualquier medio de comunicación conocido actualmente o que se desarrolle en el futuro de cualquier forma en todo el mundo (incluyendo, sin limitación, Internet y al aire) ahora o en el futuro sin consideración adicional (donde sea legal), consentimiento o revisión previa, y previa solicitud proporcionará consentimiento por escrito para dicho uso. Las Partes exentas no son responsables de ningún problema o desperfecto técnico de cualquier red o línea telefónica, sistemas en línea de computación, servidores u otros servicios, proveedores, equipos de computación, software, falla de cualquier correo electrónico debido a problemas técnicos o congestión del tráfico en Internet o en cualquier sitio web, o cualquier combinación de estos, incluyendo, sin limitación, ningún tipo de daño a la computadora de los participantes o de otras personas relacionado con la participación o la descarga de cualquier material en este Sorteo o que sea resultado de dicha participación ni por otros errores o dificultades de ningún tipo, ya sean humanos, mecánicos, electrónicos, informáticos, de la red, tipográficos, de impresión o de otro tipo que estén relacionados con el Sorteo o de algún modo conectados con este, incluidos, entre otros, errores o dificultades que puedan surgir en relación con la administración del Sorteo, el procesamiento de las Entradas, el anuncio de los Premios, la entrega de los Premios u otro material relacionado con el Sorteo. Todas las interpretaciones de este Reglamento oficial y las decisiones del Patrocinador son definitivas. No se permiten Entradas generadas por software, robots, programas, scripts, macros u otros medios automáticos. El Patrocinador se reserva el derecho, a su exclusivo criterio, de descalificar a cualquier individuo (y de anular todas las Entradas asociadas) del que sospeche o confirme que haya realizado las siguientes acciones: (i) que haya utilizado entradas generadas por software, robots, programas, scripts, macros u otros medios automáticos o cualquier otro medio para alterar el proceso de entradas; (ii) que haya adulterado el proceso de entrada o la operación de este Sorteo; (iii) que esté actuando en contra de este Reglamento oficial; (iv) que esté actuando en forma desleal o perjudicial, o con la intención de molestar, abusar, amenazar o acosar a otras personas; o (v) que haya brindado información imprecisa en cualquier documento legal presentado en relación con este Sorteo. Los Participantes aceptan, y por el presente liberan de cualquier responsabilidad a las Partes exentas, que estas (a) no serán responsables de ningún reclamo, pérdida, daño o lesión de ningún tipo (incluida la muerte) que resulte, en forma total o parcial, directa o indirecta, de la participación en el Sorteo o de cualquier actividad relacionada con el Sorteo o de la aceptación, recepción, posesión, uso, mal uso o inhabilidad de utilizar el Premio y (b) no otorgan ninguna garantía, declaración o seguridad, expresa o implícita, de hecho o derecho, respecto del Premio, incluidas, entre otras, la calidad de dicho Premio o la adecuación para un fin en particular. Las Partes exentas no serán responsables de ningún daño o lesión, pérdida, gasto, accidente, retraso, inconveniente o irregularidad que pueda ser provocada o generada por (1) cualquier acto u omisión indebido, negligente, no autorizado por parte de cualquier agente, asistente, empleado o contratista independiente; (2) cualquier acto u omisión indebido, negligente, no autorizado por parte de cualquier persona o entidad que no sea un empleado de las Partes exentas; o (3) por cualquier otra causa, condición o evento de cualquier tipo que esté más allá del control de las Partes exentas. El incumplimiento del Patrocinador de hacer cumplir cualquier disposición del presente no representará una renuncia a dicho derecho. El Patrocinador se reserva el derecho a modificar este reglamento para mayor claridad, sin que ello afecte materialmente los términos y condiciones del Sorteo. Si, por algún motivo, el Sorteo no se pudiera realizar según lo planificado, incluidos, entre otros, una infección por un virus informático, falla, adulteración, intervención no autorizada, fraude, fallas técnicas o cualquier otra causa fuera del control del Patrocinador que pueda corromper o afectar la administración, la seguridad, la equidad, la integridad o la conducta adecuada de este Sorteo, el Patrocinador se reserva el derecho, a su exclusivo criterio, de cancelar, terminar, modificar o suspender el Sorteo. En caso de que el Sorteo se termine antes de la fecha de vencimiento establecida, se publicará una notificación donde el Patrocinador crea conveniente y los premios no otorgados se otorgarán mediante un sorteo al azar entre todas las Entradas elegibles recibidas por cada sorteo hasta el momento del cierre o se otorgará de cualquier otra forma que sea justa y equitativa según lo determine el Patrocinador. En tal caso, el Patrocinador se reserva el derecho de otorgar los Premios al azar entre las Entradas elegibles recibidas a lo largo del Período de vigencia del sorteo y en general, hasta el momento del impedimento. El incumplimiento por parte del Patrocinador de cualquiera de los términos de este Reglamento oficial no constituirá una renuncia a dicha disposición. SE SEGUIRÁN LAS NORMAS PARA LA SELECCIÓN DE UN ÁRBITRO, EXCEPTO QUE EL ÁRBITRO DEBERÁ TENER EXPERIENCIA EN DERECHO PROMOCIONAL Y ESTAR AUTORIZADO PARA EJERCER COMO ABOGADO EN TEXAS. EL RECURSO PARA CUALQUIER DEMANDA SE LIMITARÁ A LOS DAÑOS REALES, Y EN NINGÚN CASO NINGUNA DE LAS PARTES TENDRÁ DERECHO A RECUPERAR DAÑOS PUNITIVOS, EJEMPLARES, CONSECUENTES, ESPECIALES, INDIRECTOS O INCIDENTALES, INCLUIDOS LOS HONORARIOS DE ABOGADOS U OTROS COSTOS RELACIONADOS CON LA PRESENTACIÓN DE UNA DEMANDA, O A RESCINDIR ESTE ACUERDO O SOLICITAR MEDIDAS CAUTELARES O CUALQUIER OTRA REPARACIÓN EQUITATIVA. LOS PARTICIPANTES ACEPTAN QUE CUALQUIER DISPUTA, RECLAMO O CAUSA DE ACCIÓN QUE SURJA DEL SORTEO O QUE ESTÉ RELACIONADA CON ESTE SORTEO SE RESOLVERÁ INDIVIDUALMENTE SIN RECURRIR A NINGUNA FORMA DE ACCIÓN CONJUNTA.

8.
